AI, CCPA, and Patient Privacy Risk in Plastic Surgery and Med Spas

AI (artificial intelligence) is integrating into plastic surgery practices and med spas’ lead generation, treatment planning, and patient experience efforts. Facial recognition tools, imaging simulators, and enhancement tools that analyze and recommend treatments are no longer proof of concepts; they are being implemented daily.[1]

What is less understood is how much risk these tools bring with them. These applications have some of the most sensitive information an organization can collect. While HIPAA provides guidance around protected health information in clinical settings, it does not extend to all patient interactions—particularly those outside formal medical records.[8]

Website visits, online consultations, targeted advertising platforms, and many AI-powered tools collect consumer data that is not tied to a medical record. That data is governed by CCPA.2

That doesn’t mean HIPAA isn’t a concern, but rather organizations need to understand where one law ends and another begins.
